Terms and Conditions

These terms govern the use of the aulasmoodle.com site and the general conditions for engaging our technology services for educational platforms. By using the site or engaging a service, you accept these conditions.
1. Identification
This English version is provided for convenience; in case of discrepancy, the Spanish version prevails.
Grupo de Soluciones Creativas S.A.C., with RUC (Peruvian tax ID) 20607431117 and registered address at Las Almendras 286, San Martín de Porres, Lima, Peru, owner of the trademarks AulasMoodle (aulasmoodle.com) and Aulaxis (aulaxis.com). AulasMoodle is transitioning to its new brand, Aulaxis, with the same team.

2. Purpose
These terms govern access to the site and the general conditions of the services we offer:
- Implementation of Moodle platforms and virtual classrooms.
- Moodle SaaS (managed platform), hosting, VPS servers and Cloud infrastructure.
- Platform migrations and upgrades.
- Support and maintenance.
- Development of plugins, themes and custom solutions, including reporting, gamification and payment gateways.
- Integrations with WordPress, ERP, CRM and other systems.
- Custom software and e-learning platform development.
- Instructional design, educational materials and SCORM courses.
- Training, proctoring, videoconferencing and consulting.
3. Use of the Site
The content of aulasmoodle.com, including the blog, is for informational purposes only and does not constitute a binding offer. The conditions of each service are defined in its proposal.
The site may not be used for unlawful purposes, to attempt to access unauthorized areas, to interfere with its operation, or to copy its content for commercial purposes without authorization.
4. Engagement and Quotation
Each service is engaged through a quotation or proposal accepted in writing, which defines scope, timelines, deliverables, service levels and price. Quotations are valid for the period stated in each document.
Inquiries are handled through this site’s forms, WhatsApp, email, or through Aulaxis (aulaxis.com).
5. Scope and Changes
Only what is described in the accepted proposal is included. Any change in scope is assessed, quoted and approved in writing before it is carried out.
6. Prices, Taxes and Payments
Prices are stated in Peruvian soles (PEN) or US dollars (USD), depending on each proposal, and indicate whether taxes are included. We accept bank transfer and PayPal. Payment terms and dates are detailed in each contract or proposal.
7. Timelines, Deliverables and Acceptance
Timelines run from acceptance of the proposal and from the client’s delivery of the information and access required. Each deliverable is deemed accepted when the client approves it or raises no objections within the agreed period.
8. Managed Services (SaaS, Hosting, Cloud and Support)
Availability, backups, response times and support are governed by the service levels agreed in each contract or plan. We may schedule maintenance, giving reasonable advance notice.
Hosting and server plans are engaged for set periods (monthly or annual) and renew as agreed. Plan resources (storage, memory, concurrent users) are those stated in the proposal; if usage exceeds them, we will propose a plan change before applying it.
The client is responsible for the use of its platform and its content; the infrastructure provider may apply its own usage policies.
9. Client Obligations
- Provide truthful information and the access required to render the service.
- Designate a project owner.
- Protect its credentials and manage its users’ permissions.
- Be responsible for the content it publishes on its platform and hold the rights to that content.
10. Acceptable Use of the Platforms
The platforms we implement or operate may not be used to:
- Distribute malicious software, send unsolicited email (spam), or attack other systems.
- Publish illegal content or content that infringes the copyrights, trademarks or other rights of third parties.
- Attempt unauthorized access or engage in activities that affect the stability of the service.
11. Third-Party Software and Moodle
We provide services built on open-source software such as Moodle, subject to its own licenses, and on third-party services (Cloud providers, videoconferencing, payment gateways), subject to their own terms. Moodle™ is a registered trademark of Moodle Pty Ltd; AulasMoodle and Aulaxis are independent providers and are not affiliated with Moodle Pty Ltd.
12. Intellectual Property
Code developed on a custom basis for a client becomes the client’s property once paid in full. We retain ownership of our own tools, components and prior know-how, which the client may use within its solution.
The text, images and trademarks on this site belong to their respective owner or owners.
13. Confidentiality
We treat as confidential the information the client provides to us in order to render the service. We may sign confidentiality agreements when the project requires it.
14. Personal Data
We process personal data in accordance with our Privacy Policy and with Law No. 29733, Personal Data Protection Law, and its regulations.
15. Warranty on Developments
Custom developments include a warranty to correct, at no additional cost, errors attributable to the work delivered. Unless the contract or proposal states another period, the warranty runs for six (6) months from delivery or go-live. At the client’s request, the contract may set a longer period, for example one (1) year.
The warranty does not cover changes in scope, new features, errors caused by third-party modifications, updates to Moodle or other components not contemplated in the proposal, or issues with the client’s infrastructure. These are handled through support or a new quotation.
16. Suspension and Termination
We may suspend a service for non-payment or for use contrary to these terms, upon prior notice. Upon termination of a managed service, we provide the client with a copy of its information in a standard format.
17. Limitation of Liability and Force Majeure
We are not liable for indirect damages, loss of profits, or failures caused by third parties or events of force majeure. [TO BE CONFIRMED limitation of liability with legal counsel]
18. Links to Other Sites
The site links to aulaxis.com, to our demo platform, and to third-party sites (for example, client projects). We are not responsible for the content of third-party sites.
19. Complaints Book
We make available a virtual Complaints Book (Libro de Reclamaciones), in accordance with the Consumer Protection and Defense Code (Código de Protección y Defensa del Consumidor). You may access it from the Complaints Book page of this site.
20. Changes
We may update these terms. The version in force is the one published on this page, together with its update date.
21. Governing Law and Jurisdiction
These terms are governed by the laws of the Republic of Peru. Disputes are submitted to the courts of Lima.
